1. Acceptance of Terms
Welcome to Picturan ("we," "our," or "us"). These Terms and Conditions ("Terms") govern your access to and use of our mobile application and services. By accessing or using Picturan, you agree to be bound by these Terms.
2. Eligibility
You must be at least 13 years old to use Picturan. By using the app, you represent and warrant that you meet this requirement. We reserve the right to suspend or terminate accounts found to be in violation of this requirement.
3. User Accounts
To access certain features, you are required to create an account using supported login methods (such as Google Sign-In). You are responsible for maintaining the confidentiality of your account and for all activities that occur under it.
4. Use of the App
Picturan allows users to upload images, generate AI-based coloring pages, and create edited artwork. You agree to use the app only for lawful purposes and in accordance with these Terms. We grant you a non-exclusive, revocable, non-transferable license to use Picturan for personal, non-commercial purposes.
5. User Content and Rights
You represent and warrant that you have the necessary rights and permissions to upload and use any content within the app. We are not responsible for any content uploaded by users that violates the rights of third parties.
You retain ownership of the images you upload and the content you create using the app. However, by using Picturan, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, process, display, and distribute your content for the purposes of operating, improving, and promoting the app. This includes the use of generated or edited content for marketing, promotional, and service-related purposes.
6. Prohibited Conduct
You agree not to use the app to:
- Upload or process content that is illegal, harmful, abusive, or otherwise objectionable
- Upload content that infringes on intellectual property or other rights of third parties
- Attempt to misuse, disrupt, or interfere with the app or its services, including but not limited to hacking, reverse engineering, or attempting to gain unauthorized access
- Use the app for any unauthorized or unlawful purpose
We reserve the right to remove content or suspend accounts that violate these rules.
7. AI-Generated Content Disclaimer
The app uses third-party artificial intelligence services to generate coloring pages. AI-generated results may not always be accurate, complete, or suitable for all purposes. We do not guarantee the quality, accuracy, or reliability of generated outputs. You are solely responsible for how you use any content generated through the app.
8. Subscriptions and Billing
Picturan offers subscription-based access to certain features. Subscriptions automatically renew unless canceled. You may manage or cancel your subscription through the Apple ID subscription settings. All billing, payments, and refunds are handled by the platform provider (such as the Apple App Store), and we do not process payments directly. No refunds will be provided for any unused portion of the subscription term. Any unused transforms or credits do not roll over.
9. Termination
We reserve the right to suspend or terminate your access to the app at any time, with or without notice, if you violate these Terms or if we determine that your use of the app poses a risk to us or other users. You may terminate your account at any time through the app.
10. Limitation of Liability
We are not liable for any indirect, incidental, special, or consequential damages, including loss of data, loss of profits, or loss of use, arising out of or related to your use of the app.
11. Disclaimer of Warranties
The app is provided on an "as is" and "as available" basis. While we strive to maintain a reliable and high-quality experience, we do not guarantee that the app will always be uninterrupted, error-free, or fully accurate. This includes any content generated through the app's features.
12. Changes to These Terms
We may update these Terms from time to time. Any changes will be posted within the app, and the "Last Updated" date will be revised accordingly. Continued use of the app after such changes constitutes your acceptance of the updated Terms.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of the Philippines.
